We were discussing this in our secret forum, actually.

If the 'offense' isn't too horrible, and past user behavior has been good, it might slide by, with or without a warning (depending).

Example: Kieron posts a spam thread. He gets a one-day ban because he does this way too often, among other things.

Sergeantkyle posts a spam thread. He gets a small warning because this happens a bit, but not eccessively and usually it's just trivial stuff.
